Assured Shorthold Tenancy Agreement

An Assured Shorthold Tenancy Agreement is a legally binding document for a tenant and landlord to sign. This document is for a specific type of tenancy. Assured Shorthold Tenancy is the most common tenancy agreement used in England and Wales in which a tenant has the right to stay in a property for a certain period of time, as long as they pay the rent and abide by the terms of the tenancy agreement. The landlord also has terms they must adhere to in the agreement, such as not stopping by unannounced. The Assured Shorthold Tenancy typically lasts for six months and up to a year, wherein the landlord cannot evict the tenant without proper cause.

Our Assured Shorthold Tenancy Agreement template can be customised to include a Guarantor clause. When a legal document template is with a Guarantor it means the landlord has required a secondary person to the Agreement to be responsible for the tenancy agreement. A Guarantor states they will pay the rent if the main tenant is in default or cannot otherwise fulfil an obligation under the Agreement.

The Guarantor does not have to be living in the same dwelling. The idea is for a student or person without a regular income to still be able to rent a property, without undue risk to the landlord. Even a bad credit history and credit score will not be a problem if an Assured Shorthold Tenancy Agreement with Guarantor is in place because there is a “backer” to pay the rent if need be. Once the document has been signed by all parties it shall become a legally binding agreement.

The protection the Assured Shorthold Tenancy Agreement offers is for both parties. For a full explanation of the tenant’s and landlord’s rights and responsibilities to each other please see our Guides section. Any tenancy document that is signed will explain fully the situation one is agreeing to. These documents are for use in any tenancy situation that will be six months to a year, as that can be considered short term.
